David Feldman, of Feldman & Feldman, filed suit in Travis County on January 14 to seek declaratory judgment from a TPIA request by Dallas Morning News. “It’s one of those unique things you run into when the attorney general is a criminal defendant, and he also has a separate role – for example, under the public information act. All parties have an interest in protecting the rights of the defendant,” Mr. Feldman, who was appointed by the trial judge to represent the prosecutors, said.

Feldman & Feldman sue Attorney General’s office to block records

On October 14, 2015, Dallas Morning News requested copies of the investigative records pertaining to Ken Paxton’s securities fraud investigation. Following an Attorney General letter notice that the sensitive case information should be release, David Feldman of Feldman & Feldman filed suit in Travis County to block the release of sensitive case information. “We’re having to sue the AG so we don’t have to disclose information adverse to the AG that we shouldn’t have to disclose under the law… Fundamentally, it comes down to the notion of a fair trial and avoiding pretrial publicity that might be prejudicial,” Mr. Feldman, who was appointed by the trial judge to represent the prosecutors, said.
